1. OUR COMMERCIAL POLICY
1.1
The Seller offers for sale, on www.lalu-excellencefood.com, the products and carries out its e-commerce activity exclusively towards its end users who are “consumers”.
1.2
When we speak of “consumer” we refer to any natural person who acts on www.lalu-excellencefood.com for purposes not related to his own commercial, entrepreneurial or professional activity, possibly carried out. If you are not a “consumer”, please refrain from concluding commercial transactions on www.lalu-excellencefood.com.

In consideration of its commercial policy, the Seller reserves the right not to process orders from subjects other than the “consumer” or in any case to orders that do not comply with its commercial policy.

These General Conditions of Sale exclusively regulate the offer, forwarding and acceptance of purchase orders for products on www.lalu-excellencefood.com between users of www.lalu-excellencefood.com and the Seller.

2. HOW TO CONCLUDE THE CONTRACT WITH THE SELLER
2.1
To conclude the purchase contract for one or more products on www.lalu-excellencefood.com, you will need to follow the purchase procedure until the order confirmation and relative payment.
2.2
In the order form, displayed immediately before the conclusion of the purchase contract, we will provide you with summary information about the essential characteristics of each product ordered, the price (including all applicable taxes or duties) and shipping costs.
The contract is concluded upon receipt by the Seller, electronically, of the order form, after verifying the correctness of the data and once the payment of the order is completed and you have received the order confirmation from the Seller.
2.3
The order form will be filed in our database within the time limits required by law. You will be able to access your order form by consulting the appropriate section.
2.4
When sending the order, you will be warned that such forwarding implies the obligation to pay the indicated price.
2.5
The languages ​​available to conclude the contract with the Seller are Italian, English and Chinese.
2.6
Once the contract is concluded, the Seller will process your purchase order.
2.7
The Seller may not process your purchase orders that do not give sufficient guarantees of solvency, which are incomplete or incorrect or in the event of unavailability of the products. In this case, we will inform you by e-mail within thirty (30) days that the contract is not concluded and that the Seller has not carried out your purchase order. The Seller will reimburse, without undue delay, what you have already anticipated and the contract will be considered terminated between the parties, or will propose alternative products.
2.8
By paying for the order, you unconditionally accept and undertake to observe these General Conditions of Sale in relations with the Seller. If you do not agree with some of the terms set out in the General Conditions of Sale, please do not proceed with the payment of the order for the purchase of products on www.lalu-excellencefood.com.
2.9
By paying for the order, you confirm that you know and accept the General Conditions of Sale and the additional information contained in www.lalu-excellencefood.com, also referred to via links, including the Privacy Policy and the Information on Right of withdrawal.
2.10
Once the contract is concluded, the Seller will send you, by e-mail, a purchase order confirmation containing a summary of all the information.

3. GUARANTEES AND INDICATION OF PRODUCT PRICES
3.1
The essential characteristics of the products are presented on www.lalu-excellencefood.com within each product sheet. However, the images and colors of the products offered for sale on www.lalu-excellencefood.com may not correspond to the real ones due to the Internet browser and monitor used.
3.2
The Seller does not sell used, irregular or inferior quality products to the corresponding market standards
3.3
The Seller, in case of exercising your right of withdrawal, has the right not to accept the return of products that have been altered in their essential and qualitative characteristics or that have been damaged.
3.4
Product prices may vary. Make sure of the final sale price before submitting the related order form.
3.5
Purchase requests from countries not listed on the country selection page will not be accepted by the Seller
4. PAYMENTS
4.1
The prices shown are inclusive of VAT, packaging and packaging.
4.2
To pay the price of the products and the related shipping costs, you can follow one of the methods indicated in the order form.
4.3
In case of payment by credit card, the financial information (for example, the number of the credit / debit card or the date of its expiry) will be forwarded, via encrypted protocol, to the provider of the relative remote electronic payment services, without that third parties may, in any way, have access to it. Furthermore, this information will never be used by the Seller except to complete the procedures relating to your purchase and to issue any refunds, or if it is necessary to prevent or report to the police the commission of fraud on www.lalu-excellencefood.com.
5. SHIPPING AND DELIVERY OF PRODUCTS
To find out about the specific shipping and delivery methods of the products, click on the appropriate link. Please pay attention to what is reported in this section because the information contained therein form an integral and substantial part of these General Conditions of Sale and, therefore, are deemed to be fully known and accepted by you at the time of placing the order.
All products are certified for high quality and subjected to thorough checks when shipped. Should you receive a product that is not in perfect condition, please contact us immediately by sending an email to ordini@lalu-excellencefood.com
In the particular case of Easter eggs, given the natural fragility of the product, in case of breakage during transport, please contact us immediately by sending an email to ordini@lalu-excellencefood.com indicating all the order specifications.

7. RIGHT OF WITHDRAWAL
7.1
For all orders placed by the European Union, Directive 2011/83 establishes a right of withdrawal in favor of the consumer within 14 days of delivery of the goods.
You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) working days, from the day of receipt of the products purchased on www.lalu-excellencefood.com, by giving notice to the Seller.
7.2
To withdraw from the contract you will need to contact us at ordini@lalu-excellencefood.com specifying the products purchased, the relative order number, your identification data and bank details (holder and C / C number, ABI, CAB, CIN ) for the refund of the amount paid for the purchase of the products. You will need to return the products to the Seller at LALU srl – Piazza E. Duse, 4 – 20122 Milan – Italy. The Seller must receive them within fourteen (14) working days from when you received the products.
7.3
The shipping costs for the original delivery of the purchased products will not be refunded. The return shipment, on the other hand, is free, if you decide to use our courier. If, on the other hand, you decide to use a different courier, the return shipping costs will be at your expense.
7.4
The right of withdrawal is however subject, in addition to the conditions specified in the previous points, also to the following conditions:
• The waybill must be correctly filled in
• The right of withdrawal applies only to goods intact at the time of return;
• The products must not have been used, modified or damaged;
• The products must be returned in a single shipment to the Seller;
• The products must be returned in their original packaging;
• The Seller must receive the returned products within fourteen (14) working days from the date of delivery of the order.
After our warehouse has received the return, it will check that all the conditions are in place to accept it.
7.5
In the event that the withdrawal is exercised in accordance with the above conditions, the Seller will refund the customer the entire amount collected for the purchase of the products, within 30 days.
7.6
If the methods and terms for exercising the right of withdrawal are not respected, you will not be entitled to a refund of the amounts already paid to the Seller; however, you will be able to get back, at your expense, the products in the state in which they were returned to the Seller. Otherwise, the Seller may keep the products, in addition to the sums already paid for their purchase.
8. REFUND TIMES AND METHODS
8.1
After the return of the products, the Seller will make the necessary checks relating to their compliance with the conditions and terms indicated in paragraph 7. In the event that the checks are concluded positively, the Seller will send you, via e-mail, the relative confirmation of the acceptance of returned products.

9.1

10. APPLICABLE LAW AND DISPUTE RESOLUTION
10.1
The General Conditions of Sale are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206, on the consumer code in Chapter I “Of the rights of consumers in contracts”, with specific reference to the legislation on distance contracts and the legislative decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.
10.2
The competent court for the resolution of any dispute will be that provided for by the Italian legislation in force at the time of the conclusion of the contract.
We also inform you that the European Commission provides a platform for alternative out-of-court dispute resolution, accessible on the website http://ec.europa.eu/odr.

11. MODIFICATION AND UPDATE
The General Conditions of Sale are amended from time to time, also in consideration of any changes in the laws. The new General Conditions of Sale will be effective from the date of publication on www.lalu-excellencefood.com.
